  • US Supreme Court Approves Trump's Travel Ban

He proved instrumental in advancing gay rights, buttressing abortion rights and erasing political spending limits.

The high court in June and December 2017 allowed two versions of the ban to take effect while court challenges ran their course, but had not resolved the legal merits of the challenges until now.

Supreme Court Justice Anthony Kennedy announced his resignation from the nation's highest court Wednesday, sparking immediate reaction from politicians, journalists and commentators across the political spectrum. He said he chose to retire to spend more time with family.

It's also possible that Roberts appears more liberal because, as the chief justice, he has an incentive to join the majority in cases where his vote alone can not change the decision; this tactic allows him to influence decisions he doesn't fully agree with, rather than simply dissenting. Just consider the Supreme Court's rulings of the past three days.

"Abortion rights are going to be reined in, if not eliminated", said Sam Erman, an associate professor of law at the University of Southern California, who clerked under Justice Kennedy.

President Trump said his nominee will come from that list. The Republican-led Senate can be expected to push to have the new nominee confirmed and on the court before the justices begin their next term in October.

Trump indicated he would chose a nominee from a list of 25 that the White House updated a year ago.

"President Trump has done it once, and he will do it again by appointing another great justice to the high court". "He has cared deeply about the relationship between the Constitution and individual liberty, and played a key role in helping to shape the Supreme Court's conservative jurisprudence in the areas of campaign finance and the First Amendment, gun rights and the Second Amendment, the separation of powers and federalism, and reasonable restrictions on abortion, such as the partial-birth abortion ban". Most notably, he wrote the 2015 ruling on Obergefell v Hodges, which found that a ban on same-sex marriage was unconstitutional. "That tells you that what's important about this issue is that it's an issue that affects all of us".

Schumer called on Senate Republican leader Mitch McConnell to follow the same path this year, since elections in November this year will determine who holds one-third of the chamber's 100 seats.

Yet Democrats are powerless to stop a Trump nominee without help from Republicans, since it only takes a majority vote to navigate the procedural hurdles in the confirmation process.

Trump immigration order may not prevent some family separations
She also ruled that the announced decree would replace one crisis with another: "Children have no place in prison", she said. However, at the 20-day mark, under the Flores consent decree, the department will have to release the children from custody.

There is one would-be justice among the federal appeals judges on Trump's shortlist who would scoop the median-voter title from Roberts, at least as measured by Judicial Common Space scores - and that's Thomas Hardiman, a judge who serves on the 3rd U.S. Circuit Court of Appeals.

But Fox News identified five names from the list who are considered frontrunners.

Kennedy's replacement could be pivotal in paring back abortion rights, potentially even challenging the Supreme Court's landmark Roe v. Wade ruling in 1973 that gave women a constitutional right to obtain the procedure.

Kennedy was nominated to the court by President Ronald Reagan in 1987 and sworn in the following year.
